BUILDING MAINTENANCE AND STRATA MANAGEMENT (EXEMPTION OF CERTAIN MANAGEMENT CORPORATIONS FROM SECTION 27 (1)) ORDER 2006

In exercise of the powers conferred by section 134 (1) of the Building Maintenance and Strata Management Act 2004, the Minister for National Development hereby makes the following Order:

Citation and commencement
1.   This Order may be cited as the Building Maintenance and Strata Management (Exemption of Certain Management Corporations from Section 27 (1)) Order 2006 and shall come into operation on 1st December 2006.

Exemption
2. (1)   Subject to sub-paragraphs (2) and (3), a management corporation 

(a) constituted by no more than 2 subsidiary proprietors;

(b) constituted by 3 subsidiary proprietors for a strata title plan with 4 lots;

(c) for a strata title plan with no more than 3 lots; or

(d) constituted by any number of subsidiary proprietors who are joint subsidiary proprietors of all the lots in the strata title plan,

shall be exempt from section 27 (1) of the Act if the management corporation by a resolution by consensus resolves that it wishes to be so exempted.

(2)   The exemption shall have effect from the date of the resolution.

(3)   If

(a) the resolution is revoked; or

(b) the management corporation ceases to come within any of the descriptions in sub-paragraph (1) (a), (b), (c) and (d),

the exemption shall cease to have effect on the expiry of the period of 6 months from the date of such revocation or cessation, as the case may be.
