BY THE BUILDING AND CONSTRUCTION AUTHORITY (“BCA”). BY ACCESSING THIS PORTAL AND/OR
USING THE ONLINE SERVICES THEREIN, YOU AGREE TO BE BOUND BY THE FOLLOWING TERMS
AND CONDITIONS. IF YOU DO NOT ACCEPT ANY OF THESE TERMS OR CONDITIONS, YOU MUST
IMMEDIATELY DISCONTINUE YOUR ACCESS OF THIS PORTAL AND/OR USE OF THE ONLINE SERVICES.

without the prior written consent of the BCA. Save and except with the BCA's prior
written consent, you may not insert a hyperlink to this portal or any part thereof
on any other portal or "mirror" or frame this portal, any part thereof, or any information
or materials contained in this portal on any other server, portal or webpage.
All trade marks, service marks and logos used in this portal are the property of
the BCA and/or the respective third party proprietors identified in this portal.
No licence or right is granted and your access to this portal and/or use of the
online services should not be construed as granting, by implication, estoppel or

replaced from time to time and at any time, without notice in the absolute discretion
of the BCA.

or the use of this portal will be provided uninterrupted or free from errors or
that any identified defect will be corrected; further, no warranty is given that
this portal or any information or materials are free from any virus or other malicious,

4. EXCLUSION OF LIABILITY

Under no circumstances shall the BCA be liable regardless of the form of action
for any failure of performance, system, server or connection failure, error, omission,
interruption, breach of security, computer virus, malicious code, delay in operation
or transmission, transmission error or unavailability of access in connection with
your accessing this portal and/or using the online services even if the BCA had
been advised as to the possibility.
In no event shall the BCA be liable to you or any other party for any damages, losses,
expenses or costs whatsoever (including without limitation, any direct, indirect,
special, incidental or consequential damages, loss of profits or loss of opportunity)
arising in connection with your use of this portal, or reliance on any information,
materials or online services provided at this portal, regardless of the form of
action and even if the BCA had been advised as to the possibility of such damages.
This exclusion clause shall take effect to the fullest extent permitted by the Law.
5. INDEMNITY

You hereby agree to indemnify the BCA against all damages, losses, expenses and
costs (including legal costs) suffered or incurred by the BCA in connection with
or arising from your breach of any of these Terms and Conditions.
6. MISCELLANEOUS
|
|
The BCA may terminate your access to this portal and/or your use of the online services
at any time without notice and without assigning any reason thereto.
You hereby agree to keep confidential and not disclose to any other party your user
id and login password.
7. GOVERNING LAW AND JURISDICTION
|
|
These Terms and Conditions shall be governed by, and be construed in accordance
with, the laws of Singapore and you agree to submit to the non-exclusive jurisdiction
of the Singapore courts. You hereby agree to admit these terms and conditions as
an original document and will not challenge the admissibility of the terms and conditions
on the grounds that it is made electronically.
In the event that the laws of the jurisdiction you are in do not permit or impose
restrictions on the access to the contents of the portal, you shall forthwith discontinue
access or comply with such restrictions.
8. PAYMENT FOR APPLICATIONS

|
In the event that any application you submit through the portal is approved by BCA,
you shall pay to BCA an application fee the quantum of which shall be set out at
Paragraph 7 in Instructions for Identity Verification of Prospective Workers (“Instructions”)
9. DOCUMENTS TO BE BROUGHT ON THE SCHEDULED VERIFICATION DATE

If you application is approved, you will be accorded a date (the “Scheduled Verification
Date”) on which the workers to whom the application relates are to be present at
BCA Academy for the purposes of identity verification. You shall procure that the
each of the workers attends at BCA Academy and bring along the original copies of
the following documents on the Scheduled Verification Date:-.
- (a) In-Principle Approval (IPA).
- (b) Worker’s passport;
- (c) Letter of Authorisation (the form of which is set out in the Instructions);
and
- (d) Receipt.
For the avoidance of doubt, applications are to be submitted strictly in accordance
with the Instructions, failing which, BCA may reject them. In submitting an application,
you are deemed to have agreed to comply with the Instructions and warrant that all
documents submitted online along with the application are genuine and undertake
that the original copies of such documents will be produced for verification on
the Scheduled Verification Date
Identity verification here connotes BCA verifying that the workers present at BCA
Academy are the workers who attended the relevant test(s) in the source countries.
10. CANCELLATION, POSTPONEMENT AND REFUND
|
|
BCA shall be entitled to postpone the date of identity verification for any reason
whatsoever without refund of application fee paid or compensation to you or any
other person.
BCA shall further be entitled to cancel the identity verification for any reason
whatsoever. Except where BCA cancels the identity verification for reasons not attributable
to any fault on your or the workers’ part, no refund of any application fee paid
will be made in the event of cancellation. In the event that BCA cancels the identity
verification for reasons not attributable to any fault on your or the workers’ part,
your remedy shall be limited to a refund of any application fee paid.
For the avoidance of doubt, you shall not be entitled to postpone the date of identity
verification or amend or cancel the application in any way after it has been approved.
11. CAPACITY OF APPLICANT

|
By submitting any application on the portal, you warrant that you are:- .
- (a) the prospective employer of the workers to which the application relates; or
- (b) the duly authorised agent of the prospective employer mentioned above.
